Petition filed challenging election of Nandi Hills MP Alfred Keter

A voter in Nandi Hills has filed a petition at Eldoret High Court challenging the election of Alfred Keter as the area MP elect.

Robert Kibet Kemei yesterday Tuesday moved to court to challenge IEBC’s declaration of Keter as Nandi Hills MP-elect.

According to the petitioner, Keter flouted electoral laws by campaigning outside the stipulated official campaign timelines set out by the Independent Electoral and Boundaries Commission (IEBC).

“I have moved to court to seek justice which I believe will be done. We believe the court will look at the facts of the case to prove our case and deliver a fair judgment,” Kemei said.

The Jubilee MP elect Alfred Keter is listed as the first respondent and the IEBC as the second respondent.

In a sworn affidavit, the petitioner argues that Keter had been busy engaged with gubernatorial campaigns in Uasin Gishu leaving it late to make a last minute dash when he realised that his opponent back at Nandi Hills had gained significant political clout.

He argues that by then, the stipulated campaign time had lapsed.

Joshua Maritim the petitioner’s lawyer said they have a strong case which they hope will be dispensed by the end of December and justice delivered to his client as stipulated by the law.

Keter allegedly panicked when he was alerted that the ground was hostile and was shifting in favour of Independent candidate Bernard Kitur. Residents had faulted Keter accusing him of abandoning the constituency after JP primaries and choosing instead to spend the better part of his time in Uasin Gishu.

The petitioner also accuses the IEBC of failure to conduct the Nandi Hills parliamentary elections in accordance with the electoral code of conduct. This the petitioner argues the IEBC was notified of Keter’s departure from the stipulated campaign schedule but the commission failed to take action against him.

The IEBC declared Alfred Keter as the MP-elect with 23,923 votes against his closest challenger Bernard Kitur (13,872).

Keter was sworn in on Thursday at the National Assembly as the MP for Nandi Hills.
