Members of National Assembly Kangogo Bowen (Marakwet East), Joyce Emanikor (Turkana County), Mohammed Lokiru (Turkana East) were duly elected, this follows rulings by the Court of Appeal in Eldoret on Thursday.
On Kangogo Bowen, the Marakwet East MP won an appeal against High Court decision that nullified his election in February.
The Court of Appeal reinstated Mr Bowen’s election victory overturning the High Court decision after finding that the petitioner, Mr Sammy Kipkeu Kemboi, failed to prove beyond reasonable doubt his claims of massive irregularities in the election.
While delivering the verdict, Judges Erastus Githinji, Fatuma Sichale and Hannah Okwengu ruled that Mr Kemboi failed to cite enough evidence to prove the claims.
The appellate court spelled out that although there were some irregularities in some polling stations, they were not enough to affect the final outcome of the election and warrant a nullification of the election.
“The petitioner failed to give solid evidence to the effect that the MP was not validly elected. In any case, the results of three polling stations where irregularities were reported could not affect the final result, ” said the judges.
Following the ruling, Bowen’s supporters burst into wild celebrations as they carried the legislator shoulder high.
On Joyce Emanikor, the appellate court similarly upheld her election as the Woman Representative for Turkana County.
The Judges Erastus Githinji, Fatuma Sichale and Hannah Okwengu said the petitioner, Pauline Lokuruka, failed to substantiate claims of massive irregularities in the election.
In its ruling, the court said that there was no evidence to prove that the election was not free and fair.
Following the ruling Emanikor expressed satisfaction that Justice had finally been served: “the people of Turkana voted for the Women Rep of their choice,” she said while addressing the press outside the appellate court.
“We thank the Court of Appeal for establishing the facts, I thank the people of Turkana who have stood with me from when they voted for me until now,” she said.
She extended an olive branch to her competitors in the August poll urging them and their supporters to join her and unite Turkana.
“My competitors are welcome, I will be the Women Rep for all, let us unite Turkana,” she said.
The Court of Appeal also upheld the election victory of Turkana East MP Mohammed Lokiru.
