Court of Appeal in Eldoret has reinstated the election victory of Nandi Hills MP Alfred Keter, overturning the High Court ruling that had nullified the election.
Keter had appealed the nullification of his August 2017 poll victory.
Hundreds of Keter supporters that were camped outside the Eldoret High Court anticipating the ruling are celebrated in jubilation.
The ruling was delivered by Court of Appeal Judges Erastus Githinji, Fatuma Sijale and Anna Okwengu.
Lawyer Otiende Amollo for Keter had argued that reasons that led to nullification of his client’s victory, that he campaigned beyond stipulated time, were untrue.
However, lawyer Amos Magut for the petitioner had maintained that their case was solid.
High Court Judge Justice Kimondo had nullified Keter’s win on March 1 citing election malpractices.
Keter had been declared the winner of the Nandi Hills August poll with 28,923 votes against 13,872 garnered by his rival Bernard Kitur.
